Overview
Welcome to BioAura. The terms "BioAura", "we", "us" and "our" refer to ROMA ECOMM LLC, which operates this store and website, bioaura.us, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.
These Terms of Service ("Terms"), together with our Privacy Policy (https://bioaura.us/policies/privacy-policy), Shipping Policy (https://bioaura.us/policies/shipping-policy) and Refund Policy (https://bioaura.us/policies/refund-policy), describe your rights and responsibilities when you use the Services. By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Not medical advice
BioAura sells storage and travel accessories: coolers, cases and reusable pens. We do not sell medication, cartridges or needles, and nothing on the Services is medical advice. Always follow your medication's label or package insert and your doctor's or pharmacist's instructions for storing and using your medication. Check your medication's temperature regularly. Temperature ranges, capacities and dimensions are those stated by the manufacturer and may vary with outside conditions and use. Check current TSA and airline rules before you travel.

2. Access and account
You must be at least the age of majority where you live to use the Services or place an order. The information you give us must be correct, current and complete. You're responsible for keeping your account credentials secure and for all activity on your account.

3. Our products
We try to show our products as accurately as possible, but colors and appearance may vary depending on your screen. Product descriptions, availability and prices may change without notice. We may limit quantities or discontinue any product at any time.

4. Orders
When you place an order, you make an offer to buy. We may accept or decline any order for any reason; your order is accepted when we confirm it and receive your payment. If we can't fulfill or must cancel an order, we'll contact you and refund any amount charged. Your purchases are for your personal or household use, not for resale.

5. Prices and payment
Prices are in U.S. dollars and may change without notice. The price you pay is the price shown when you place your order, as confirmed in your order email. Unless stated otherwise, prices don't include applicable taxes. You confirm that you're authorized to use the payment method you provide.

6. Shipping, returns and warranty
Shipping is described in our Shipping Policy, and returns, refunds and our 30-day warranty in our Refund Policy. Delivery times are estimates. Title and risk of loss pass to you when we hand your order to the carrier; our Shipping Policy explains how we help with lost or damaged packages.

7. Intellectual property
All content on the Services, including the BioAura name, logo, text, images, graphics and design, belongs to ROMA ECOMM LLC or its licensors and is protected by law. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute or modify any content without our written permission.

8. Third-party tools and links
The Services may include tools or links provided by third parties, offered "as is". We're not responsible for third-party websites, products or services, and your use of them is at your own risk and subject to their terms.

9. Relationship with Shopify
BioAura is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with BioAura (ROMA ECOMM LLC). By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and BioAura, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with BioAura.

10. Privacy
Your personal information is handled under our Privacy Policy (https://bioaura.us/policies/privacy-policy), and some of it may be subject to Shopify's Privacy Policy (https://www.shopify.com/legal/privacy/app-users).

11. Reviews and feedback
If you send us reviews, ideas or other feedback, you allow us to use, publish and display it for any purpose, including marketing, without payment. Your feedback must be truthful, must be your own, and must not be unlawful or infringe anyone's rights. You must disclose any compensation or incentive you received for a review.

12. Errors
Information on the Services may occasionally contain errors in descriptions, prices or availability. We may correct errors and update information, or cancel orders affected by them, at any time, including after you've placed your order (in which case we'll refund you).

13. Prohibited uses
You may use the Services for lawful purposes only. You may not use them to break any law, infringe anyone's rights, harass anyone, send spam, upload malicious code, interfere with the Services' security, or scrape or copy the Services with automated tools without our permission. We may suspend or terminate access if you violate these Terms.

14. Warranties
Our products come with the 30-Day Limited Warranty described in our Refund Policy. To the extent permitted by law, any implied warranties are limited to the 30-day period of that warranty, and the website and its content are provided "as is" and "as available". Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.

15. Limitation of liability
To the fullest extent permitted by law, BioAura, ROMA ECOMM LLC, Shopify and our respective affiliates, officers, employees, agents and suppliers are not liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits, data or revenue, arising from your use of the Services or any product. To the extent permitted by law, our total liability for any claim related to a product is limited to the amount you paid for that product.

16. Indemnification
You agree to indemnify and hold harmless BioAura, ROMA ECOMM LLC, Shopify and our affiliates from any claims, damages and costs (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.

17. Termination
We may end your access to the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) will continue to apply.

18. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms and our policies are the entire agreement between you and us about the Services. You may not assign these Terms without our consent; we may assign them.

19. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. You agree to the jurisdiction of the state and federal courts located in California.

20. Changes to these Terms
We may update these Terms at any time by posting the new version on this page. Your continued use of the Services after a change means you accept the updated Terms.
